1 These are the website terms and conditions for Stone River Jewellery (UK) Limited registered in England and Wales (Company number 6494566) having its Registered Office at Grover House, Grover Walk, Corringham. Essex. SS17 7LS

2 Website use

This website is operated by Stone River Jewellery (UK) Limited (referred to as “we/us/our”). As a user, all uses of this website, including any transactions including the supply of any products, are subject to these terms and conditions. We reserve the right to change these terms and conditions at any time. However you will be asked to read and accept the terms and conditions each time you place an order to ensure you are familiar with the most up to date version.

3 Your contract with us

3.1You will have an opportunity to correct any errors before submitting your order. Once we receive your order we will send you an order acknowledgement email detailing the items you have ordered. Please note that this is not an order confirmation or order acceptance from us.

3.2 All orders are subject to acceptance by us. Acceptance of your order and completion of our contract with you will take place when we send you an email confirming that the product has been dispatched (Dispatch Confirmation).

4 Prices and Payment

4.1 The price of any product will be as quoted on our site from time to time, except in cases of obvious error. All prices are shown in Sterling and include VAT where applicable but exclude delivery charges. Delivery charges are explained in the section “Delivery” below. No gift vouchers are available online.

4.2 The total cost of your purchase including Delivery charges will be shown before you submit your order. If an item becomes unavailable we will let you know as soon as possible and provide a full refund if payment has already been made.

4.3 We try very hard to ensure that all the information contained in our website is correct. However if we do discover an error in the price or description of an item which you have ordered we will let you know as soon as possible. We will give you the option of purchasing the item at the correct price or of cancelling the order.

4.4 We are under no obligation to provide the product to you at the incorrect lower price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as mis-pricing.

4.5 We accept payment by Visa, Solo, Mastercard, Delta, Electron, Maestro and Switch. Our payment partner is Pay Pal, who provide a secure online payment service. Payment is deducted when your order is processed. Pay Pal is one of the worlds leading online payment services and only Pay Pal will have access to your card details when goods are purchased through this site.

4.6 We can accept personal cheques but cannot dispatch goods until the funds have cleared. Please allow 5-7 days for clearance after we have received your cheque. If you wish to pay by cheque please e-mail your order to: customerservices@stoneriverjewellery.co.uk including the product code, colour and quantity. We will confirm we have stock available, the price and delivery charges before you send your payment to us. Cheques should be made payable to: Stone River Jewellery UK Ltd. 5 Jewellery

5.1 Please note that all jewellery sizes shown on our website are approximate & provided for your guidance only, and stated ring sizes may vary, unless adjustable. We have made every effort to describe colours, sizes, lengths & materials as accurately as possible, however colours & images depend upon your own monitor and browser. We do not guarantee that products appear exactly the same as on your monitor. All metals, stones, material descriptions are based upon the details our suppliers have given & to the best of our knowledge are true & accurate. All plating complies with government guidelines.

5.2 The Swarovski stone or Swarovski crystal products sold on this website are genuine Swarovski stones/crystals but the finished products are not made by Swarovski and has no association with Daniel Swarovski, The Swarovski Swan, Swarovski logo, Swarovski.com or Swarovski AG.

The colour and design of gift boxes may vary, subject to availability.

6 Jewellery Care

Please note your Costume/Fashion jewellery are fashion items and as such require handling with care no matter how high the quality. The life of the metal plating can be enhanced with a little care and the following tips can help you to keep your jewellery at its best.
We recommend you apply perfume to your body and allow to dry before putting on your jewellery, as otherwise application of perfume whilst wearing jewellery may affect the plating or beading. Jewellery should be put on last and taken off first when dressing to avoid any damage to jewellery or clothes. Also you should avoid bringing your jewellery into contact with hairspray, house hold chemical products, cleaning fluids etc. Continued wear of your fashion item will in time result in the plating starting to wear away or discolouration, this is not considered a fault as is due to natural wear & tear. If jewellery should get wet due to sweating, wash gently with water and wipe dry with a soft cloth, if this should occur regularly it may cause discolouration or plating wear. Do not use any abrasive jewellery cleaners. Jewellery should be stored in a dry place and to avoid scratching it should be stored separately.

7 Delivery

7.1 Our standard charge within the UK is £3.95 for packing and delivery

7.2 We aim for delivery within the UK in 3-7 working days of your order being accepted but please allow up to 20 working days. Deliveries will be sent by Royal Mail Recorded Delivery for the UK to the address stated in your order (this requires a signature at destination, the recipient signature may not necessarily be the addressee). For your security the delivery address should match the cardholders billing address used during the order process. While we aim to get your order to you promptly we do not guarantee delivery times and are not responsible for delays beyond our reasonable control. We do not deliver to PO box addresses. Delivery times may vary around Christmas, New Year, Bank/Public holidays and other busy periods. Once a signature has been obtained this concludes the delivery.

7.3 Delivery in Europe (inc Ireland) is International signed for £7.95 and includes packing and delivery, we aim for delivery within 5-10 days of your order being accepted but please allow up to 20 working days. We will notify you by e-mail that your order has been dispatched and is in transit. While we aim to get your order to you promptly we do not guarantee delivery times abroad and are not responsible for delays beyond our reasonable control. Delivery times may vary around Christmas, New Year, Bank/Public holidays and other busy periods. For your security the delivery address must match the cardholders billing address used during the order process. We do not deliver to PO box addresses. Your item will need to be signed for by the recipient (not necessarily the addressee) and the delivery will be recorded at the nearest local post office®. Once a signature has been obtained this concludes the delivery. Delivery country options will be available at the checkout.

7.4 Delivery Worldwide is International Signed for £10.50 and includes packing and delivery, we aim for delivery within 5-10 working days of your order being accepted but please allow up to 20 working days. We will notify you by e-mail that your order has been dispatched and is in transit. While we aim to get your order to you promptly we do not guarantee delivery times abroad and are not responsible for delays beyond our reasonable control. Delivery times may vary around Christmas, New Year, Bank/Public holidays and other busy periods.For your security the delivery address must match the cardholders billing address used during the order process. 8 Consumer Rights

8.1 If you are contracting as a consumer, you may cancel a contract at any time within seven working days, beginning on the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our refunds policy (set out in clause 9 below)

8.2 To cancel a Contract, you must inform us by writing to the address given below or by emailing us at customerservices@stoneriverjewellery.co.uk or phoning us on 01255 479955 (please quote your reference number). You must also return the Product(s) to us immediately, in the same condition in which you received them, unworn and in its original packaging with tags unbroken and seal attached and at your own cost and risk. You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

8.3 You will not have any right to cancel a Contract for the supply of any of the following Products:
(i) Pierced Products
(ii) Bespoke items made to your specification.

8.4 Where the Product you have purchased is a set which contains pierced products you may return the non-pierced items only and you will be refunded the price paid for the set less the current individual price of the pierced Product.

9 Our Refunds Policy

9.1 When you return a Product to us:
(a) because you have cancelled the Contract between us within the seven-day cooling-off period (see clause 8.1 to 8.4 above), on receipt of the returned products we will process the refund due to you as soon as possible. We will refund the price of the Product in full, excluding the original P & P delivery charge. You will be responsible for the cost of returning the item to us. If you cancel your contract with us & wish to return product(s) for a refund you must return the products(s) to us within 14 days of the date you notified us.

We strongly advise you arrange proof of return as we can not accept responsibility for parcels lost in transit. Please note proof of posting is not proof of delivery.
 
(b) for any other reason (for instance, because you claim that the Product is defective), we will examine the returned Product and will notify you of any refund via e-mail within a reasonable period of time. We will usually process a refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund for the defective Product. Products returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you.

9.2 We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

10 Our Liability

10.1 We warrant to you that the Product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which Products of that kind are commonly supplied.

10.2 Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchase [and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us]

10.3 This does not include or limit in any way our liability;
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

10.4 We are not responsible for indirect losses which happen as a side effect of the main loss or damage, including but not limited to:
(a) loss of income or revenue
(b) loss of business
(c) loss of profits or contracts
(d) loss of anticipated savings
(e) loss of data, or
(f) waste of management or office time
However arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

11 Import Duty

11.1 If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

11.2 Please also note that you must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable for any breach by you of any such laws.

12 Written Communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

13 Notices

All notices given by you to us must be given to Stone River Jewellery UK Limited at Stone River Jewellery (UK) Ltd, Orders Dept, 44 Page Road, Clacton-on-Sea, Essex. CO15 3AE. We may give notice to you at either the e-mail or postal address you provide us when placing an order, or in any of the ways specified in clause 1.3 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in any case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

14 Privacy Policy and Data Protection

14.1 Any personal information we collect from you will be used in accordance with the Data Protection Act 1998. The information we collect on this site includes any personal details you provide to us such as your name, address and email address. We also obtain information from using cookies. A cookie is a small piece of software which is attached to a computer’s hard disc for record keeping purposes. We use cookies in order to help us recognise when you next visit the website which helps us tailor the site in line with your preferences. We can also use cookies to compile anonymous statistics in relation to measuring the performance of our website. However this does not involve any information being collected which can personally identify you.

14.2 We use the information that you provide or that we obtain for the following purposes:-

14.2.1 to process and deliver your order and to deal with payment via our payment partner Pay Pal;

14.2.2 to help us assess and analyse our website and assist us to improve the services we provide.

We do not sell or pass on your personal information to any other parties for commercial use.

14.3 We would also like to inform you of other items which we think may be of interest to you. However when you give us your information you will have the chance to opt out of receiving such information.

14.4 You may at any time request us to make available a copy of the personal information we hold about you. Such a request, together with any other queries you have in relation to your personal data should be sent to us at the email address or postal address shown in section 16.

15 General

15.1 You acknowledge and agree that all copyrights, trade marks, design rights and any other intellectual property rights in the items displayed and the material and content on this website are owned by Stone River Jewellery (UK) Limited. You may only use, download or copy such items, material or content for your own personal and non-commercial use. Any other type of use or reproduction is prohibited.

15.2 These terms and conditions and all transactions relating to this website are governed by English law and are subject to the exclusive jurisdiction of the English courts.

15.3 These terms and conditions do not affect consumer statutory rights.

15.4 Although most lines are stock items, at times, due to high demand we may have to put your order or part of your order on to ‘back order’ if we are out of stock of an item(s). Should this occur you will be given the option of cancelling your order or item that is unavailable.

15.5 Any prizes/codes given for competitions etc must be redeemed within 60 days of issue, the prize amount must be spent in a single transaction, if you do not claim the full amount of your prize in this transaction you will lose the remaining outstanding balance, if you choose a product that is greater in value to the prize amount given, you must pay the outstanding amount. The prizes given are not exchangeable for cash or eligible for a refund or exchange, any vouchers issued as part of a prize will have no monetary value. The method of delivery & delivery times may vary to our standard delivery option/times, please allow up to 30 days to receive your prize/code. We are not responsible for any damages incurred in transit, once prizes have been dispatched.

15.6 Promotions/discounts/free shipping or any other valid promotional offer. Only one promotion code per transaction may be used at a time. Promotions/Codes can not be used in conjunction with each other. We reserve the right to withdraw any offer, at any time, without notice.

15.7  Perfect Wedding Magazine promotion. Offer ends 11.59pm on 30th June 2010. Maximum of 4 free pendants per household when purchased with matching quantity of  co-ordinated earrings. Please allow 28-90 days for delivery. Pierced products are non-returnable. This does not affect your statutory rights. In the unlikely event your purchase is faulty, any faulty products returned for a refund must also have the pendant returned with them. Promotinal code can not be used in conjunction with any other promotional codes. We reserve the right to substitute free offer item for one of equal or greater value if circumsatnces require.
